DMCA Policy

Introduction

This DMCA Policy outlines the procedures for submitting complaints regarding copyright infringement on our website. We respect the intellectual property rights of others and expect our users to do the same. If you believe that your copyrighted work has been used in a way that constitutes copyright infringement, please follow the procedures described below.

Notice-and-Takedown

If you are a copyright owner or an authorized agent and believe that any material on our site infringes your copyrights, you may submit a written notice ("DMCA Notice") to us. Your DMCA Notice must include the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered, a representative list.
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., URL or description).
  • Your contact information, including name, address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

Please send your DMCA Notice to: abuse@brand.tld

Upon receipt of a valid DMCA Notice, we will promptly remove or disable access to the allegedly infringing material and notify the user who posted the material.

Counter-Notice

If you believe that your material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your jurisdiction and will accept service of process from the person who provided the original DMCA Notice.

Send your counter-notification to: abuse@brand.tld

Upon receipt of a valid counter-notification, we may restore the material unless the original complainant files a court action seeking to restrain such restoration.

Freeze of Payments

In the event of a DMCA dispute, we reserve the right to freeze or withhold any payments related to the allegedly infringing content until the issue is resolved. This freeze will remain in effect until a final decision has been made by the administration or a court of competent jurisdiction.

Final Decisions

The decision of our administration regarding DMCA complaints and counter-notices is final, unless overridden by a court order. We reserve the right to remove content, terminate accounts, or take any other action deemed appropriate in response to DMCA complaints.
